If payment is not received in full by Dec 31, 2023 in the amount of $9,500 a felony criminal complaint for Theft of Service against you will be filed with the Montgomery County District Attorney & Sheriff’s Office (additional counties include Archer & Wichita). Additionally, a civil suit for damages will be filed against you with the Montgomery County, Texas courts of law.
Until payment for all services rendered to Comstock Energy Resources LLC & Strategy Lateral LLC is received in full the deficit amount will compile interest alongside attorney & court fees. This interest, itemized by invoice issue date will accrue at 20 percent every 30 days past due in accordance with Texas statutes. Facts of the complaint are as follows:
- On Mar 4, 2023, was contacted by Mr. Jerry Nickel Jr. to design & produce websites for the aforementioned companies.
- Initial website design project & payment terms were agreed with Mr. Jerry Nickel Sr. via phone on Mar 7, 2022 & documented via email on Mar 14, 2022
- Mr. Nickel provided design feedback & project guidance via email on April 21, 2022 & May 12, 2022.
- The completed websites were provided digitally to Mr. Jerry Nickel Sr. on May 26, 2022 including the final website design project invoice.
- Hosting & maintenance service fees accrued (after 4 mos complimentary) per the rates documented on Mar 14, 2022, until the present as the website project remains unpaid – necessitating hosting / maintenance & security services.
- Two monthly payments for hosting & maintenance service received July 26, 2023
- Multiple collections communications & a settlement offer were made.
- Mr. Jerry Nickel Jr. attempted to obfuscate his role in the company.
- Mr. Jerry Nickel Sr. attempted to “cancel” service w/o making payment.
- Memorialized evidence includes hosting verification, SMS, email & phone records.
- Payment may be remitted electronically via the previously emailed invoices or PayPal, Zelle etc. to jpoland00@gmail.com or mailed check to the address on the invoices.
- Business Aliases include: Jerry Nickel 4SR Motorcycle Racing Suits 23435 FM1314, Porter, TX 77365. Patricia Mayo Bookkeeping.
